A-LIST PLUS MEMBERSHIP TERMS & CHECKOUT AGREEMENT

ARTICLE I. DEFINITIONS

In addition to terms defined elsewhere in this Agreement, the following definitions apply:

(a) “Agreement” means this Membership Terms & Checkout Agreement, together with any policies referenced herein.

(b) “A-List Plus Membership” or “Membership” means a recurring subscription program offered by Skin With Bea Esthetics that provides periodic aesthetic treatments, exclusive pricing, discounts, and member-only benefits, subject to the terms of this Agreement.

(c) “Billing Period” means the recurring four-month (4-month) interval selected at checkout, during which Membership benefits are earned and made available.

(d) “Effective Date” means the date you complete checkout and enroll in the Membership.

(e) “Treatment” means any professional aesthetic service performed by Skin With Bea Esthetics, including but not limited to injectable treatments, laser treatments, microneedling, and facials.

(f) “Injectables” means neuromodulators and injectable aesthetic treatments, including Botox®.

(g) “Products” means retail skincare or other physical goods sold by Skin With Bea Esthetics.

(h) “You” or “Your” means the individual enrolling in and using the Membership.

ARTICLE II. ACCEPTANCE OF TERMS

By enrolling in the A-List Plus Membership, You acknowledge and agree that:

  1. You have read and understand this Agreement;
  2. You agree to be bound by all terms herein;
  3. Membership benefits are subject to medical discretion, candidacy, and safety standards;
  4. Membership benefits are not insurance, not a treatment guarantee, and not refundable except as required by law.

ARTICLE III. MEMBERSHIP DESCRIPTION & BENEFITS

Section 3.01 Who the Membership Is For

The A-List Plus Membership is designed for individuals who wish to receive Botox or similar and in-office skin rejuvenation treatments approximately every four (4) months, as part of a long-term, results-focused skin health plan.

Section 3.02 Core Membership Benefits

During each four-month Billing Period, and while Your Membership is active and in good standing, You are eligible for:

  1. One (1) Botox or similar treatment, up to sixty-four (64) units, administered at Provider’s discretion based on clinical appropriateness and treatment plan;
  2. One (1) in-office rejuvenation treatment, consisting of either:
    • Lutronic Ultra laser treatment or
    • Microneedling using Dermapen
      (Selection subject to candidacy and provider recommendation.)

Unused treatments do not roll over beyond the applicable Billing Period unless expressly stated in writing by Provider.

Section 3.03 Additional Member Benefits

While enrolled and in good standing, Members also receive:

  • 20% off all Treatments, excluding Injectables
  • 15% off retail Products, with up to 30% off Products during monthly in-office treatment visits, at Provider’s discretion
  • VIP Botox or similar pricing for additional units beyond the included 64 units, currently $11 per unit, subject to change with notice
  • Access to Members-Only Flash Sales and exclusive promotions

Discounts:

  • Apply only while Membership is active
  • Do not stack with other promotions unless explicitly stated
  • Apply only to designated services or products

Section 3.04 Sign-Up Bonus

Upon enrollment in the A-List Plus Membership, Members receive one (1) 90-minute Personalized Facial as a sign-up bonus.

This facial:

  • Has no cash value
  • Is non-transferable
  • Must be redeemed while Membership is active
  • May expire if not scheduled within the timeframe specified by Provider

ARTICLE IV. MEDICAL & TREATMENT TERMS

Section 4.01 Medical Discretion & Candidacy

All Treatments are subject to:

  • Medical judgment
  • Safety considerations
  • Health history
  • Contraindications
  • Provider discretion

Enrollment in the Membership does not guarantee eligibility for any specific treatment.

Section 4.02 Health Representation

By enrolling, You represent that:

  • You are in suitable health to receive aesthetic treatments
  • You will disclose all relevant medical history, medications, allergies, and conditions
  • You will notify Provider of any changes to Your health status

Section 4.03 Assumption of Risk

You acknowledge that aesthetic treatments involve risks, side effects, and variable outcomes. By participating, You voluntarily assume all associated risks and agree to follow all pre- and post-treatment instructions.

ARTICLE V. PAYMENT TERMS

Section 5.01 Membership Fees

Membership pricing and billing frequency are disclosed at checkout. Membership fees are:

  • Charged automatically each Billing Period
  • Not based on usage
  • Required regardless of whether treatments are scheduled or used

Section 5.02 Non-Refundable

All Membership fees are non-refundable, including:

  • Unused treatments
  • Missed appointments
  • Unused discounts
  • Sign-up bonuses

Except where required by law, no refunds or credits will be issued.

Section 5.03 Failed Payments

Failure to maintain valid payment information may result in:

  • Suspension of Membership benefits
  • Delay or forfeiture of scheduled treatments
  • Termination of Membership

ARTICLE VI. CANCELLATION & TERMINATION

Section 6.01 Cancellation by Member

You may cancel Your Membership in accordance with the cancellation instructions provided at checkout or via written notice to Provider.

Unless otherwise required by law:

  • Cancellation becomes effective at the end of the current Billing Period
  • No refunds are issued for the current or prior Billing Periods

Section 6.02 Provider Right to Terminate

Provider may suspend or terminate Membership if:

  • Payment obligations are not met
  • Policies are violated
  • Misuse, abuse, or unsafe behavior occurs

In such cases, unused benefits may be forfeited.

ARTICLE VII. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Provider makes no guarantees regarding treatment outcomes
  • Provider is not liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount paid by You to Provider in the twelve (12) months preceding any claim

ARTICLE VIII. GOVERNING LAW

This Agreement is governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any legal action shall be brought in a court of competent jurisdiction located in Maricopa County, Arizona, unless otherwise required by law.

ARTICLE IX. MISCELLANEOUS

  • Memberships are non-transferable
  • Benefits may be modified prospectively with notice
  • This Agreement constitutes the entire agreement between You and Provider
  • If any provision is found unenforceable, the remainder remains in effect
